We pride ourselves in providing the highest possible levels of customer service, and consequently problems are rare. However, we recommend that you read this page carefully before buying an activity pack from us. These terms and conditions form the basis of a contract between us (Funday) and you (the purchaser).

Website description and photography

We have tried hard to ensure that descriptions and illustrations used on our website are accurate, however, photographs are intended to give a general idea of the activity described, and do not form part of any contract between you and Funday.

Insurance

£50,000 personal accident insurance is included free of charge. Full details of insurance cover are included in your voucher pack. Please note that insurance is not available for activities that take place abroad.

Voucher validity

Vouchers are usually valid for 12 months. You will find the expiry date printed on the voucher. You are advised to check activity seasons in your voucher pack information as the activity may only run during a certain time of year due to supplier or activity restrictions. You must book and complete your experience prior to the expiry date, extensions are not available and vouchers unredeemed by the expiry date will become invalid. Certain promotions will be for vouchers with a reduced validity period of 6 months from the date of purchase. This will be detailed upon the promotional page on the website.

Refunds

If you are not satisfied with your voucher pack, please contact us within 28 days and we will happily arrange a full refund. Refunds will be paid back onto the credit/debit card used to place the original order. Refunds will be given no later than the 28 day period from the date of purchase and only on receipt of a Funday voucher, complete with the tear-off supplier receipt. Refunds cannot be issued once a date has been booked with a supplier.

Suppliers

Activities featured on this website are provided by suppliers who are neither employed by, nor acting as agents of, Funday. Although we have visited many of the suppliers, we are not able to examine all the equipment, or facilities, of every single supplier, nor are we able to vet every single one of their employees. Consequently, Funday cannot accept liability for any act or omission or negligence of a supplier, nor any other liability arising out of the provision of the activities to you. Funday is not a provider of services. Funday does not accept liability for damage to property or consequential loss or injury of any kind, except where death or injury is caused by the negligence of Funday or its servants or agents. In no circumstances Funday's total liability for any claim exceed the price of the voucher or product supplied. Activities are provided by the supplier subject to the supplier's own terms and conditions, a copy of which will be made available to you on request.

Age, size and health restrictions

For safety reasons, some activities have certain size, age and health restrictions. Unless otherwise stated on the website, the minimum age for any activity is 14. You are required to notify the Supplier of any relevant medical condition. The Supplier will be able to advise on any restrictions at the time of booking.

If you need to cancel or change your activity

Once a booking has been made with a supplier, you are bound by that supplier's terms and conditions and cancellation policies. These will be made available upon request from the supplier and will vary depending upon the supplier and activity.

If a supplier cancels or changes your activity booking

From time to time an activity booking may need to be cancelled. This may be due to group size restrictions and minimum numbers required for a supplier to run an activity, or may be due to other unforeseen circumstances beyond the supplier's control. In the case of a cancellation, you will be rebooked by the supplier for another date convenient for both parties. Rebooking policies will vary depending upon the supplier and the experience booked, and will be made available upon request by the supplier. Should your activity be cancelled, you will only be able to rebook with the supplier that took the original booking.

Weather

Some activities, notably flying, may be cancelled due to weather conditions, mechanical failure, or for other reasons beyond a supppliers control. Your supplier information sheet will advise you if you need to call the supplier to check weather conditions or a flight information line before participating. If your event is cancelled because of the weather, you will be able to rebook for a date on which you are able to attend. Funday is unable to reimburse travel, accommodation or other incidental expenses incurred by you in attending an activity, which is cancelled for any reason.

In case of problems

In case of a problem, please speak to the supplier on the day, so they have the opportunity to resolve any problems there and then. Any other complaints should be addressed to the customer service department at Funday, who will take up the problem with the supplier on your behalf.

Prices

We reserve the right to change prices without notice, provided we inform you before the order has been dispatched and payment has been taken. Vouchers will not be issued until payment is collected in full.

Price Guarantee

Our price guarantee is available for like for like activities only. The refund of the price difference will only be issued following confirmation by Funday that the experience being provided by an alternative online gift experience agency is an exact match to the experience featured on Funday.com. The price comparison will be made to the full RRP and will NOT take into account temporary discounts or promotional prices.

Contracts (Rights of Third Parties) Act 1999

A person who is not named on the face of the activity voucher or activity purchase letter has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms and conditions of booking.

Internet Purchasing

If you are buying an activity from our website, funday.com, you must read and accept the terms and conditions on the site. We draw your attention to the following points.

  1. You must be a UK resident
  2. You must not buy activities for re-sale
  3. You must have the funds to meet your obligations under any concluded contract.

If one or more of these points is found to be untrue or of there is an obvious mistake arising between the parties then Funday has the right, within 14 days of issuing an acknowledgement of service, to withdraw from the contract without liability.

These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and Funday agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause.
